Tuktuk (“we”, “our”, “us”, or the “Application”) is a product owned and operated by Sigler Digital Solution Pvt. Ltd., a company incorporated under the Companies Act, 2013 (“Company”). This Privacy Policy describes how we collect, use, disclose, and safeguard the personal and non-personal information of users (“User”, “You”) who use the Tuktuk Audio & Chat App.

By using the Application, You agree to the collection and use of your data in accordance with this Privacy Policy. If You do not agree, You should immediately stop using the Application.

This Privacy Policy is published in compliance with Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

2. USER CONSENT

By accessing or using the Tuktuk App, You confirm that You:

  • Have read, understood, and agreed to this Privacy Policy;
  • Voluntarily provide your information to the Application; and
  • Consent to the collection, storage, processing, and use of your information in the manner described herein.

Your continued use of the App shall constitute express and unconditional consent to this Policy and any future updates.

3. INFORMATION WE COLLECT

We may collect the following categories of information from You:

(a) Personal Identifiable Information (PII):

Information that can directly or indirectly identify You, such as:

  • Mobile Number (for OTP verification)
  • Gender (optional)
  • Location (if permitted by the User)
  • Profile Image (if uploaded)

Information that does not identify You individually, including:

  • App usage statistics
  • Crash logs and analytics data

(c) Voice and Chat Interaction Data:

Tuktuk may access your microphone only when you initiate an audio call or voice chat. No call or chat content is recorded, stored, or monitored by Tuktuk.

(d) Payment and Transaction Data:

If You purchase coins or premium features, our payment partners (e.g., Razorpay, Google Pay, UPI) may collect necessary financial data such as transaction ID, payment mode, and timestamps. Tuktuk does not store card, UPI, or banking information on its servers.

4. PURPOSE OF INFORMATION COLLECTION

Tuktuk collects information for the following legitimate and lawful purposes:

  • To verify User identity and maintain account security
  • To enable audio call and chat features
  • To personalize and improve the user experience
  • To detect and prevent fraud or misuse
  • To manage payments, wallet balance, and in-app purchases
  • To comply with applicable Indian laws and regulations

We do not sell, rent, or trade User data with any third party for marketing purposes.

5. NETWORK PERMISSIONS

Tuktuk requires access to:

  • Microphone: For enabling voice calls
  • Internet & Network State: For connecting calls and chats
  • Storage (optional): To upload or display profile images

You may deny permissions, but doing so may limit certain app features.

6. DATA RETENTION & DELETION

Your personal data is retained only for as long as necessary to provide services or comply with legal obligations. If You wish to delete your account and data:

Upon verification, your profile and associated data will be permanently deleted from our servers within 15 business days (excluding legal retention obligations).

7. SECURITY MEASURES

Tuktuk implements industry-standard encryption, access control, and monitoring practices to safeguard your data. All transactions are processed through secure SSL connections. However, no online platform can guarantee absolute security. Users are advised to protect their login credentials and use the Application responsibly.

Sigler Digital Solution Pvt. Ltd. shall not be liable for any unauthorized access, phishing attempts, or breaches resulting from the User’s negligence.

8. DATA SHARING AND DISCLOSURE

Tuktuk may share information only under the following circumstances:

  • Legal Requirements: When required by law, government authorities, or court orders;
  • Fraud Prevention: To protect the App, Users, or the public from harm;
  • Service Partners: Limited technical sharing with trusted vendors (like hosting or payment gateways) for operational purposes.

No chat, call, or personal data is shared with advertisers or external marketing agencies.

9. CHILDREN’S PRIVACY

Tuktuk is intended only for Users aged 18 years and above. We do not knowingly collect or process data of minors. If we learn that information from a minor has been submitted without verified parental consent, we will delete it promptly.

10. USER RESPONSIBILITY

  • Maintaining confidentiality of their login credentials
  • Ensuring that the information provided is accurate and updated
  • Using the App for lawful, non-harmful purposes

Tuktuk shall not be liable for any emotional, psychological, or interpersonal outcomes arising from chat or call interactions.

11. LIMITATION OF LIABILITY

Tuktuk and Sigler Digital Solution Pvt. Ltd. shall not be held responsible for:

  • Any loss or damage resulting from misuse of personal information by Users or third parties;
  • Service interruption, network issues, or device malfunction;
  • The content, tone, or authenticity of conversations between Users.

All communications on Tuktuk are strictly for social and entertainment purposes only.

12. THIRD-PARTY LINKS

The Application may contain links to third-party websites or services. Tuktuk is not responsible for the content, security, or privacy practices of such third parties. Users are encouraged to read their respective privacy policies before interacting with external links.

13. DISCLAIMER

Tuktuk does not guarantee the accuracy, tone, or personality of any chat or call experience. All interactions are voluntary, and Users are expected to exercise discretion. No part of the service constitutes professional or emotional advice.

14. GRIEVANCE OFFICER

16. GOVERNING LAW AND JURISDICTION

This Privacy Policy and any disputes arising hereunder shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal, India.

18. ADDITIONAL DATA RETENTION NOTICE

No voice or chat content is stored or monitored unless required under a lawful government order.
